Medium and Long-term Strategic Skills List (MLTSSL)
and
Short-term Skilled Occupation List (STSOL)
On 19 April 2017, the Department of Immigration and Border Protection made major changes in Occupation Lists. These changes has profound effect on the eligibility and/or limitation of many individuals who applied or in the process of application for some work and skilled visas. These new lists mostly affected the 457 visa program. However, many other visas has also effected as some occupations were removed and/or not eligible to apply for certain visa like state sponsored subclass 190 and 489 visas. The changes are as follow:
- Medium and Long-term Strategic Skills List (MLTSSL) replaced the previous ‘Skilled Occupation List’ (SOL)
- Short-term Skilled Occupation List (STSOL) replaced the previous ‘Consolidated Sponsored Occupation List’ (CSOL)
Medium and Long-term Strategic Skills List (MLTSSL)
This list is applied for the below visas and the applicant’s occupation should be in this list if applying for the following visas:
- Skilled Independent visa (subclass 189)
- Skilled Regional (Provisional) visa (subclass 489) – Family nominated
- Temporary Graduate visa (subclass 485) – Graduate Work Stream.
Also the occupation on this lists are only eligible for 4 years Subclass 457 visas and other occupations only can only be granted Subclass 457 visas with a Maximum of 2 years validity (Please click here to read more about announced changes in 457 visa program).
The MLTSSL also forms part of the STSOL which is used for employer sponsored and state nominated visas. There are 16 occupations on the MLTSSL which cannot be used for state nominated and employer sponsored visas ie:
- Skilled Nominated Subclass 190 visas
- Skilled Regional Provisional Subclass 489 visas (State Nominated)
- Employer Nomination Scheme Subclass 186 visas (Direct Entry)
- Temporary Worker (Skilled) Subclass 457 visas
- Training Subclass 407 visas
Occupations being on the MLTSSL but not on the STSOL is certainly unexpected, and we expect there will be some changes to the MLTSSL from 1 July with these occupations quite possibly being removed from the MLTSSL also.

Short-term Skilled Occupation List (STSOL)
This list is applied for the below visas and the applicant’s occupation should be in this list if applying for the following visas:
- Skilled Nominated Subclass 190 visas
- Skilled Regional Provisional Subclass 489 visas (State Nominated)
- Employer Nomination Scheme Subclass 186 visas (Direct Entry)
- Temporary Worker (Skilled) Subclass 457 visas*
- Training Subclass 407 visas
* Some of the Occupations for 457 visa program comes with Caveat which explained in another article in our website.
200 occupations have been removed from the CSOL to create the STSOL.
In addition, there are 24 “regional” occupations on the STSOL which are only open for:
- Skilled Regional Provisional Subclass 489 visas (State Nominated)
- Employer Nomination Scheme Subclass 186 visas
- Temporary Worker (Skilled) Subclass 457 visas where the employment is in a regional area as specified for RSMS visas

In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions in a limited service restaurant. A limited service restaurant includes, but is not limited to, any of the following:
- a) fast food or takeaway food services;
- b) fast casual restaurants;
- c) drinking establishments that offer only a limited food service;
- d) limited service cafes including, but not limited to, coffee shops or mall cafes;
- e) limited service pizza restaurants.
Note 4. Minister of Religion is specified as a skilled occupation only for the purposes of paragraph 2.72B(3)(b) of the Regulations, and only in relation to an application for a Subclass 407 (Training) visa. Minister of Religion is not specified as a skilled occupation in relation to any other visa subclass, despite paragraphs 2, 5, 6 and 8.
Note 5. In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:
- a) clerical, book keeper and accounting clerk positions;
- b) positions in a business that have an annual turnover of less than
AUD 1 million; - c) positions in a business that have fewer than five employees.
Note 6. In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions related to animal husbandry including, but not limited to, caring for livestock on a farm setting.
Note 7. In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions related to mass or standardised production, including positions based in a franchise or factory, as opposed to specialist production. Positions excluded, but not limited to the following exclusions, are any of the following:
- a) positions that involve full or partial production of food product for distribution to another location;
- b) positions that predominantly involve the use of pre-prepared food product from another location.
Note 8. In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:
- a) positions that are not located in a commercial building or shopping centre environment;
- b) positions that predominately involve the management of the provision of only one particular service to a facility or managing one particular relationship.
Example: a position that manages the cleaning contract for a facility but not other contracts relevant to the facility.
Note 9. In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:
- a) positions in a business that have an annual turnover of less than AUD 1 million;
- b) positions that have a nominated base salary of less than AUD 65,000.
Note 10: In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:
- a) positions based in a front-line retail setting;
- b) positions that predominately involve direct client transactional interaction on a regular basis;
- c) positions in a business that have an annual turnover of less than AUD 1 million;
- d) positions that have a nominated base salary of less than AUD 65,000.
Note 11. In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions involved in mass production in a factory setting and positions in a limited service restaurant. A limited service restaurant includes, but is not limited to, any of the following:
- a) fast food or takeaway food services;
- b) fast casual restaurants;
- c) drinking establishments that offer only a limited food service;
- d) limited service cafes including, but not limited to, coffee shops or mall cafes;
- e) limited service pizza restaurants.
Note 12. In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions that predominantly involve low-skilled tasks.
Examples: fruit picking or packing, feeding of livestock or animals
Note 13: In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:
- a) positions that predominately involve hair dressing and/or beauty therapy related non-managerial tasks; or
- b) positions in a business that employ fewer than five employees.
Note 14: In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:
- a) non full-time positions;
- b) positions that are not based in a therapeutic setting;
- c) positions involving the provision of non-medical relaxation massage.
Note 15: In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:
- a) positions that are based in a front-line retail setting;
- b) positions that are based in a call centre and do not require a significant technical knowledge of products;
- c) positions that predominantly involve selling educational courses to individual students;
- d) positions that have a nominated base salary of less than AUD 65,000.
Note 16: In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:
- a) truck driver positions;
- b) fleet manager positions;
- c) container controller positions;
- d) positions in a business that have an annual turnover of less than AUD 1 million;
- e) positions in a business that have fewer than five employees.
Note 17: In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any one of the following:
- a) positions in a business that have an annual turnover of less than AUD 1 million;
- b) positions in a business that have fewer than five employees;
- c) positions that have a nominated base salary of less than AUD 90,000.

Note 19: In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions that predominately involve responsibility for managing hotel or motel staff. The specification does not exclude positions that predominately involve responsibility for organising and controlling the operations of a hotel or motel that may have limited duties requiring management of hotel or motel staff but is not the main function of the position.
Note 20: In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions that do not require a minimum of two years relevant work experience.
Note 21: In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:
- a) positions in a business that have an annual turnover of less than AUD 1 million;

Note 24: In relation to specifications of occupations for Subclass 186 – Employer Nomination Scheme visa, for the purposes of sub-subparagraph 5.19(4)(h)(i)(A) of the Regulations, indicates that, despite paragraph 6, for an application for approval of a nomination for a Subclass 186 visa, the occupation excludes positions in Fast Food or Takeaway Food Service.
